Good neighbour: how high should hedges and trees be?

“Next to my tree, I lived happily…”

Désormière & Vanhalst, really like trees. In fact, we put it in our logo (we’ll tell you why in a future article). And as we love them, we asked ourselves: what is the maximum height of trees and hedges authorized in Geneva?

How can we reconcile the planting of large trees and the proximity to our neighbours? The latter may very legitimately wish to preserve good quality sunshine and views, and therefore take a dim view of a plantation growing too high.

Height of hedges and trees: what the law provides

To avoid conflicts, the federal legislator has therefore included in the law the maximum heights accepted depending on the distance between the plantation and the property line.

According to the regulations in force, unless:

  • 50 cm from the property line: plantations with woody stumps are prohibited.
  • 2 meters from the property line: plantings 2 meters high maximum
  • Between 2 and 5 meters from the property line: plantings 6 meters high maximum.
  • Between 5 and 10 meters from the property line: plantings 12 meters high maximum.

However, for the last two points, in certain cases the old law applies. Thus, we must not top trees which, as of July 10 1999, exceeded:

  • 8 meters high and located between 2 and 5 meters from the property line.
  • 16 meters high and located between 5 and 10 meters from the property line.

How do we calculate the distance?

From the centre of the plant base perpendicular to the nearest property line.

How do you calculate the height?

The height of the plantations is calculated at the limit of the neighbouring land, the authorized legal height being calculated from the level of the natural land at the limit.

Some exceptions

However, be attentive to any easements that may have been concluded between the previous owners and your neighbours. They are registered in the Land Register. Your broker or notary will be able to provide you with information on this subject.

Exceptions may also be linked to provisions relating to heritage protection as well as plantings along public roads.

Likewise, in agricultural zones, certain requirements may not apply as long as the person carrying out the planting has obtained the agreement of all the owners of neighbouring plots.

Our Advice

  • When choosing a tree or hedge species, consider the future development specific to each variety. Ask your gardener for advice.
  • Pruning, topping, or felling a tree or hedge must be subject to prior authorization issued by the DGAN (Directorate General of Agriculture and Nature). Take care to obtain it before acting, under penalty of criminal or administrative sanctions.

In a future article, we will present to you the possible remedies in the event of harmful damage to your property caused by plantations not respecting legal limits.
