Mandat simple, mandat exclusif: quel type de contrat choisir?

When you call upon a broker, you mandate them to sell your property on your behalf. You must therefore choose the sales mandate that suits you, knowing that there are two types of brokerage mandates:
- The non-exclusive mandate: you can entrust the sale of your property to several agencies. One might think that visibility will be better by multiplying brokers, but this often gives the impression of a property that is difficult to sell and therefore has flaws.
- The exclusive mandate: you entrust the sale of your property to a single agency. Sales times are shorter with this type of mandate, as real estate brokers invest much more in properties for which they have exclusivity.

- Your property will be presented in a unique way. This creates a sense of scarcity, and “scarcity” means a higher but justified price.
- The broker will be able to manage all aspects of the sale and all potential buyers. They will be able to create healthy competition between the various potential buyers, who will not be diluted across several agencies competing with each other without possible coordination.
- You will avoid the situation of having to pay the brokerage commission twice. And this is not just theory. The Federal Court has issued judgments forcing owners to pay the commission twice to two different agencies that had both worked with the same buyer.
Thus, the advantages of an exclusive mandate are manifold. The only real risk you take in entrusting an exclusive mandate is that the mandated broker does not do the work or does not do it well.
In this case, please note that you can terminate the mandate at any time, even if your contract stipulates otherwise.
Indeed, Article 404 of the Code of Obligations states that “the mandate may be revoked or repudiated at any time.” You are therefore fully protected by law.

GOOD TO KNOW
Some real estate players offer a semi-exclusive mandate that allows the seller to find the buyer themselves, in exchange for a discount on fees or a flat fee. In compensation for this fee reduction, it will then be up to you to invest yourself to close the sale.
According to the Geneva Statistics Office, using a broker allows you to sell your property for more than if you negotiate alone:
“The price per m2 of a condominium apartment is on average 18% higher when a broker participates in the transaction than when they do not. For a detached house, this difference stands at 45%.”
A broker provides you with their services, invested know-how, their time and, above all, the added value brought to the defense of your interests. All this will earn you much more than the amount of their fees.
